Our family immigration attorneys provide expert legal counsel for all aspects of immigration law, including deportation defense, writs of habeas corpus and mandamus, family-sponsored immigration, employment-sponsored immigration, investment immigration, employer compliance, temporary visas for work and college, permanent residence, naturalization, consular visa processing, waivers, and appeals.
Citizens and permanent residents of the United States have the ability to petition the federal government for an immigrant visa for certain family members. U.S. citizens can petition for more categories like Green Card Marriage, K-1 Fiancé Visas, K-3 Visas, and Same-Sex Marriage Green Cards. For people wanting to know how an immigrant visa (also referred to as permanent residency or a “green card”) can be obtained through a family member.
Family Immigration
Applying for a Green Card typically involves several steps. First, you'll need to identify your eligibility category, such as family relation, employment, or asylum. Then, an application is filed, usually by a sponsor (like a family member or employer) on your behalf. This involves submitting Form I-130 for family-based applications or Form I-140 for employment-based ones. After this, if you're already in the U.S., you file Form I-485 for adjustment of status. If outside the U.S., you go through consular processing in your home country.
Next, you'll attend a biometrics appointment, followed by an interview. You must also pass medical examinations and background checks. The final step is the decision by U.S. Citizenship and Immigration Services (USCIS) on your application. The process varies in detail based on category and individual circumstances.

Understanding Child Custody
Parenting Time
and Visitation
Parenting time, on the other hand, is where the children physically reside during the week/weekend, during summers and other major holidays. Parents can share equal parenting time or make alternate agreements.
If the children are with one parent for a majority of the time, that parent is typically referred to as the “primary custodian,” or “primary parent.” If the parents cannot agree on parenting time, a judge will examine a set of factors related to the best interests of the children and determine parenting time accordingly.
Decision-Making Ability
Decision-making refers to which parent has the right to make major decisions in the lives of their children. Colorado courts like to see the parents share joint decision-making for their children, although this is not appropriate in all cases.
Joint decision-making would mean that parents have to agree on major decisions as related to the children’s education, healthcare, and other major aspects of their lives. Joint decision-making arrangements require a collaborative effort between the parents. Decision-making is determined on a case by case basis, and in some situations, the court may award one parent sole decision-making for the children.
